General Conditions of Sale
La Semeuse SA
On-line Shopping and Mobile Application
By making an order on the internet site or the mobile application, you are binding yourself to buy the products which you have selected in conformity with the present General Conditions of Sale (hereafter the GCS).
La Semeuse offers its products for sale of the website or the mobile application within the limits of available stocks.
2. Order Confirmation
The orders you make on the internet site or the mobile application do not constitute a binding contract before you receive written confirmation from La Semeuse. This confirmation may be sent on paper or electronically, and should be transmitted by the customary means of communication.
La Semeuse reserves the right, at its own discretion, to refuse an order, particularly in the event of unpaid invoices or insolvency.
The data recorded by La Semeuse constitutes irrefutable proof of the order or the transaction. The data recorded by the payment system constitutes irrefutable proof of financial transactions.
Orders placed via prepayment must be settled within 30 days of the date of ordering. If payment is not received within the stated period, the order in question will be removed from our system and considered cancelled.
All the prices are for one article and are denominated in Swiss Francs (SFr. or CHF), VAT included. Price modifications as well as changes of a limited duration are possible at all times and do not require prior warning.
4. Means of payment
The customers of La Semeuse On-line Shopping and of the mobile application may pay their invoices by:
- Postcard, the PostFinance direct debit card
- Credit card (VISA, Mastercard)
- Bank transfer (with an e-invoice and IBAN pre-payment)
- Pre-payment on receiving an invoice on paper and paying-in slip (BVR)
Deliveries are carried out by the Swiss postal service.
Delivery charges over and above the price of the order are invoiced as indicated below. Deliveries are made carriage paid (= free delivery) from an invoice amount of SFr. 150.0 upwards.
SFr. 10.0 for any order worth between SFr. 0.0 and SFr. 49.95 SFr. 7.0 for any order worth a minimum of SFr. 50.0 Free for any order worth a minimum of SFr. 150.0

Collection of your order at our Boutique in La Chaux-de-Fonds.
If you fail to collect your order or you request it be sent by post, you will be responsible for the corresponding shipping costs.
6. Delivery periods and dispatch
Our delivery conditions are applicable to Switzerland and the Principality of Lichtenstein.
In normal circumstances, all our articles are in stock and are sent in the two working days following the order. You may at all times follow the state of your order in your account.
7. Delivery address and billing address
All orders which have been confirmed by La Semeuse will be delivered to the address indicated on the order. The delivery address may differ from the billing address. These can be modified at any time in your account or when you order.
8. Verification of the goods
It is your responsibility to verify the quantity and the condition of the goods on delivery.
If you notice that the goods have been damaged or the quantities delivered are not in accordance with the order, you should report it, make a claim with the transporter (the Swiss Postal system) and inform La Semeuse about it within 7 days of delivery. La Semeuse will then replace the missing or damaged goods with identical articles.
You may return goods which does not satisfy you within a period of 14 days from receipt of the order.
La Semeuse accepts the return of goods only in good condition and in their original packaging with the invoice.
When returns have been made in the required way, La Semeuse will reimburse the price of the invoiced returned goods and the delivery charges within a maximum period of 30 days from the reception date of the returned goods. The postal charges will be your responsibility.
10. Quality Guarantee
The La Semeuse quality guarantee makes sure you will enjoy unbeatable coffee or have it replaced free of charge if, in spite of our countless quality controls, any imperfection can be discerned.
If necessary, you only have to return the defective product, mentioning the problem beforehand in writing, to La Semeuse SA, Torréfaction de café (Coffee roasting), Allée des Paysans-Horlogers 1, CH-2300 La Chaux-de-Fonds, Switzerland.
11. Conditions of the guarantee for the coffee machines
La Semeuse guarantees, for a period of two years from the purchase date, the faultless performance of the model acquired. La Semeuse may decide on how the guarantee is carried out, between repairing it free of charge, replacing it with an equivalent model or reimbursing the price paid. All other claims are excluded.
The guarantee does not cover normal wear and tear, or the consequences of an inappropriate use or damage by the purchaser or a third party, or faults caused by external circumstances (for instance the effect of scale on the heating elements). The guarantee is only applicable if the repairs have been exclusively carried out by the La Semeuse aftersales department or by a workforce authorised and certified by La Semeuse.
Please take good care of the guarantee certificate and the purchase document (receipt and invoice). Without these documents, no claim will be accepted.

13. Right of access to the internet site or the mobile application
You are entitled to use and enjoy the internet site and the application mobile only on your own behalf, and you may not in any event, except with our written consent and with liability for prosecution, use the internet site, the mobile application or any of its content for business, publishing, advertising or any other activity which is liable to be harmful to us.
14. Applicable law
All the provisions in the present General Conditions of Sale, as well as all the purchase and sales operations concerned, are subject to Swiss law.
15. Limitation of property
We commit ourselves to do everything possible to make sure you enjoy the best possible quality of service in conformity with the values of our company. However, we cannot be held responsible for any delay in the delivery of the articles ordered or for any delay in the delivery of these articles by the Swiss postal services, who are our partner for sending out orders.
For all our vigilance and care we have shown about the partners with whom we work so you can take advantage of the services which we are offering you, we cannot guarantee that there will be no disruption of the functioning of the site and its various parts.
As a consequence:
We refuse any responsibility for direct or indirect damage which might result from access or use of the site, the mobile application or of certain of theirs elements, in the same way we refuse any responsibility which might result from the impossibility of accessing or using it.
In the same way, we refuse any responsibility for any risks linked to the installation of software for consulting the site or for any damage resulting from transmission errors, technical faults or overload or interruption in communications.
16. Protection of personal data
Whatever the nature of the personal data about you with which we are required to become conversant, we bind ourselves to do everything possible to treat it with the strictest confidentiality, ensuring its protection and not using it except for carrying out your orders and requests, and to improve the services which may be made available to you on the site, the mobile application or to inform you about their development.
You may nevertheless at any time take advantage of your right to access, correction and deletion of this data via your customer account or by writing to us by e-mail.
17. Force majeure
La Semeuse will do all in its power to carry out its obligations but it may not be held responsible for delays or failure to deliver caused by circumstances outside its control, such as strikes, wars, natural catastrophes or other events of any kind which prevent the production, transport or delivery of the products.
In the event of delay, La Semeuse will carry out its obligations as soon as possible and reserves the right to apportion the remaining stocks of products between its customers in an equitable way.
